Gowanda Pine Hill Cemetery Association Rules and Regulations
RULES AND REGULATIONS FOR THE GOWANDA PINE HILL CEMETERY ASSOCIATION ACCEPTABLE TO THE DIVISION OF CEMETERIES AS BEING IN CONFORMANCE WITH THE REQUIREMENTS OF THE LAW.
Interments in a lot in the Gowanda Pine Hill Cemetery are restricted to those entitled to burial there in according to the terms of Section 1512 of the New York State Not-for-Profit Corporation Law. Permission of those not entitled to burial according to the said Sections must be filed with the Gowanda Pine Hill Cemetery Association by the lot owner(s) prior to Cemetery approval for burial
All lots in the Gowanda Pine Hill Cemetery are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any other purposes than as a burial for human remains.
No interment shall be allowed without permission being first obtained from the Gowanda Pine Hill Cemetery Association. At the time of application for permission, the following information must be furnished.
Except as provided for in Section 1513(c) of the New York State Not-for-Profit Law, no owner may transfer his or her lot.
Burial rights obtained through inheritance should be recorded with Gowanda Pine Hill Cemetery. Section 1512(b) of the New York State Not-for-Profit Law states that unless a cemetery lot is specifically assigned by will (including reference to the lot number, section number and cemetery name), it is inherited by the descendants of the lot owner.
The full purchase price must be paid before a deed will be given or burial allowed on the lot.
The Gowanda Pine Hill Cemetery Association can refuse burial for the following reasons:
1. Non-payment of the total purchase price of the grave or lot,
2. Non-payment of the burial (interment) charges, or
3. Non-payment of an authorized lot tax.
Flowers or plants to be planted within 18 inches of the monument. The Sexton is not responsible for weeding or watering flowers. All plant containers to be removed by November 1. The Gowanda Pine Hill Cemetery Association reserves the right to remove all flowers, wreaths, or other decorations from lots as soon as they become unsightly and/or windblown.
The Gowanda Pine Hill Cemetery Association reserves the right to remove, after due notice to the lot owner, any embellishment on the lot, effigy, or inscription which, in the opinion of the majority of the trustees or directors, is unsightly or dangerous.
The Gowanda Pine Hill Cemetery Association reserves the right to restrict the planting of shrubs and to remove any shrub or tree, upon due notice to the lot owner. No trees are allowed to be planted.
Funerals must be at the cemetery so as to accommodate properly closing the grave and removing the equipment. Additional charges may apply for special arrangements.
While on the grounds of Gowanda Pine Hill Cemetery, all funerals, processions, and associated vehicles will be under the control of the Gowanda Pine Hill Cemetery Sexton or in his absence, a Trustee from the Gowanda Pine Hill Cemetery Association.
No crypt or mausoleum shall be built above ground without permission of the Gowanda Pine Hill Cemetery Association Board of Trustees and then only with acceptable specifications and in such location as they may approve
No permanent monuments or markers shall be-permitted which utilize colors other than those of natural stone
Placing of glass blocks or vases as receptacles for flowers, either artificial or grown on graves or plots is prohibited
All monument foundations will be constructed by or under the direction of the Gowanda Pine Hill Cemetery Sexton.
All work done in the cemetery shall be done by cemetery employees or under the control or with the permission of either the Gowanda Pine Hill Cemetery Sexton or a Gowanda Pine Hill Cemetery Association Trustee.
Only one monument shall be allowed on a burial site, and it shall be set in accordance with the general layout plan of the cemetery and shall conform with said plan in size and material.
Upkeep of monuments is not the responsibility of the cemetery.
All monuments or markers must be constructed of granite, bronze, or marble.
The bases of all monuments shall be finished true and level w as to fit on foundations without wedging or sprawls.
No monument will be allowed to be delivered in the cemetery until the foundation is installed and approved by the Sexton of the Gowanda Pine Hill Cemetery Association and ready to receive the monument.
No person or organization shall remove a monument from Gowanda Pine Hill Cemetery, except as provided for in Section 1510(l) of the New York State Not-for-Profit Law.
The Gowanda Pine Hill Cemetery Association may repair or remove any monuments or other markers not owned by the cemetery corporation as provided for in Section 1510(a) of the New York State Not-for-Profit Law.
Heavy trucking or other vehicular traffic shall be refused entrance to the cemetery when, in the opinion of the Gowanda Pine Hill Cemetery Sexton, injury to roads and driveways might result.
No snowmobiles, motorcycles, bicycles, or all-terrain vehicles are allowed in the cemetery. While visiting Gowanda Pine Hill Cemetery, children are to be kept under adult supervision at all times. Gowanda Pine Hill Cemetery is not liable for accidents.
Interments on Sunday, and Holidays will be governed by pre-arranged agreement between the Gowanda Pine Hill Cemetery Association Board of Trustees and the involved Funeral Director.
Graves will not be opened from December when frost and weather conditions warrant such refusal and will not be opened until weather and soil conditions are suitable for grave opening. Bodies received for interment during this time will be placed in the vault that is arranged for by the involved Funeral Director until Conditions warrant grave opening.
Cremated remains will not be permitted to be scattered in any part of the cemetery.
Concrete vaults or concrete grave liners are required to be used for all interments in graves purchased on or after March 1, 1999, and any additional provisions which may from time to time be required by the Gowanda Pine Hill Cemetery Association.
The interment of cremated remains will be permitted only in appropriate receptacles constructed of wood, metal, plastic, or concrete.
Only one (1) human remains, one (1) human remains and one (1) cremated remains, or two (2) cremated remains will be permitted in each grave in the original sections of the cemetery (A through I) and the Plumb Lot. Two (2) Cremated remains will be permitted in each cremation burial site in the Cremation Garden and in cremation burial sites in section J.
By a majority vote of the Gowanda Pine Hill Cemetery Association Board of Trustees these rules and regulations may be amended as deemed necessary.
